Privacy Notice – Communications
Regulation (EU) 2016/679 of the European Union protects all natural persons with regard to the processing of their personal data carried out by a data controller established within the territory of the European Union and grants them a number of rights, listed below, which may be exercised when applicable.
Fluxus S.B. a R.L. has its registered office at Via Boezio 4/C, 00193 Rome, Italy, and therefore applies Regulation (EU) 2016/679 to all processing of personal data, including processing necessary for correspondence purposes. Fluxus S.B. a R.L. acts as the Data Controller of such processing activities.
Fluxus may be contacted by data subjects at the postal addresses or telephone numbers available on its website http://fluxushr.it (hereinafter the “Website”).
On this basis, Fluxus provides the following information to data subjects.
A) Processing of personal data submitted for recruitment purposes or communications via the Website
Where personal data are provided by a data subject in connection with the submission of a job application, a proposal for an interview, participation in a recruitment process for a position advertised by Fluxus, or the sending of messages through the Website:
– the personal data provided, and in particular identifying data and information relating to the data subject’s education and previous professional experience, are necessary for assessing qualifications and professional background, verifying recruitment requirements, and for the potential conclusion of an employment contract with the Data Controller;
– the data subject’s consent is not required, as the collection, recording, processing, and consultation of such personal data by the Data Controller are carried out, at the request of the data subject, for the purpose of taking steps prior to entering into a contract to which the data subject would be a party;
– all personal data will be retained following periodic review in accordance with the need-to-store principle, for the entire duration of the preliminary assessment phase and, where applicable, the subsequent contractual relationship. Upon termination of the preliminary phase or (if established) the contractual relationship, the data will be archived until the expiry of the statutory limitation period pursuant to Article 2946 of the Italian Civil Code, and subsequently deleted;
– should the personal data provided include information that is unnecessary, excessive, or incompatible with the above purposes, the Data Controller will promptly delete such data. Where partial deletion is not possible, all data provided will be deleted and the data subject will be informed accordingly;
– furthermore, the data subject may, at any time prior to the conclusion of a contract and by any means, request that Fluxus cease contacting them and delete all their personal data.
In all of the above cases, the data subject has the right to request from the Data Controller:
– the rectification of inaccurate personal data concerning them;
– the completion of incomplete personal data;
– the erasure of personal data where they have been unlawfully processed or where erasure is required to comply with a legal obligation;
– the restriction of processing to personal data whose accuracy is not contested, pending verification, and to be informed before such restriction is lifted;
– the receipt of the personal data provided in a structured, commonly used, and machine-readable format, or the transmission of such data to another data controller, where technically feasible. This right does not apply to personal data not provided by the data subject or to data processed for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller.

Fluxus shall respond to each request without undue delay and, in any event, no later than one month from receipt of the request. This period may be extended by up to two additional months where necessary, taking into account the complexity and number of requests. In such cases, the Data Controller shall inform the data subject of the extension and the reasons for the delay within one month of receipt of the request.
Where requests from a data subject are manifestly unfounded or excessive, in particular because of their repetitive nature, the Data Controller may charge a reasonable fee or refuse to act on the request.
Where the data subject considers that the processing of their personal data infringes Regulation (EU) 2016/679 or that the Data Controller has failed to comply with its obligations regarding the exercise of the above rights, the data subject has the right, pursuant to Article 77 of the Regulation, to lodge a complaint with the supervisory authority of the Member State in which they habitually reside or work, or where the alleged infringement occurred, without prejudice to any other administrative or judicial remedy.
